Who we are and what these terms cover
Kyroq Ltd ("Kyroq", "we", "us") is a company registered in England and Wales, based in London. These terms govern your use of the website at kyroq.com, the Carbon Loss Register and the research published on it, and set out the basis on which we take on scoped evidence reviews. By using the site you accept them. Work we do for you is governed by a written engagement letter, which takes precedence over these terms where the two differ.
The Carbon Loss Register
The register is a public record of documented carbon-credit loss events, exposures and candidate signals, compiled from published documents. It is free to read and free to cite. Every entry names the document it rests on and says which of the three kinds it is: a loss event carries the document that decided it and the dates that document states; an exposure is a quantity with no date; a candidate is a signal whose cause the source does not state, and is not an established loss.
Licence. Register data marked CC BY 4.0 may be copied, shared and adapted for any purpose, including commercial use, provided you credit Kyroq and the edition, and link to the page, as the "How to cite" line on each edition shows. Layers marked as carried under their source's own terms, such as data taken from the CarbonPlan OffsetsDB, remain subject to those terms, which the page names. Where a layer says a tier is withheld, that tier is not published and no licence to it is given.
What the register is not. It records what published documents state, on the dates they state it. It is not complete, it is not a determination that any project has failed or will fail, and it is not advice about buying, holding, insuring, lending against or valuing any credit. A count of events is not a probability of loss. Read the coverage statement and each entry's qualification before using a quantity.
Corrections. If you believe an entry is wrong, write to corrections@kyroq.com with the entry and the document you rely on. Corrections are published as new entries with their reasons; earlier editions are preserved as published and are not rewritten.
Research and perspectives
Articles on this site are Kyroq's editorial research. They are written independently of commercial relationships, they represent our reading of the sources they cite on the date they carry, and they are not advice. Figures in them travel with their sources and retrieval dates; check the source before relying on a figure. Where an article is preserved as originally published, the date on it is the date to read it by.
Scoped evidence reviews
We carry out defined pieces of evidence work: reading a project or portfolio against its sources, comparing versions of a disclosure, and preparing evidence notes for a decision. Each engagement is agreed in writing before work begins: the question, the population, the sources, the deliverable, the timing, the fee and how confidential material is handled. We assess conflicts and information sharing for each engagement before accepting it.
What a review is. A statement of what the sources record, what the evidence supports, and what remains unresolved, attributed to the documents it rests on. Kyroq controls its methods, its conclusions and its corrections; no client has a veto over a finding, and we disclose relationships relevant to a piece of work.
What a review is not. It is not legal advice, accounting advice, a valuation, an investment recommendation, an insurance opinion or a guarantee of any outcome. Legal conclusions belong to your counsel, and whether a review can be prepared under privilege depends on how the engagement is set up. Current services provide evidence-based research and review. Predictive models are not part of the current offering.
Your responsibilities. You give us accurate information and the access the engagement needs, you do not send material you are not entitled to share, and you keep responsibility for the decisions you take on the basis of a review.
Fees. Fees, expenses, payment terms and any late payment interest are set out in the engagement letter. Where we offer a review at no charge, that offer and its scope are stated in writing and confer no further obligation on either side.
Intellectual property
The website, its design, its text and the research on it are owned by Kyroq Ltd. Register data carries the licence stated beside it. Deliverables prepared under an engagement belong to the client on payment, as the engagement letter provides; the methods, templates and know-how we use to prepare them remain ours. Source documents cited in the register and in reviews belong to their publishers; the register cites them and does not reproduce them beyond what quotation for the purpose of the record allows.
Confidentiality
Information you give us in an enquiry or under an engagement is treated as confidential, used only for the purpose it was given for, and not disclosed except as the engagement letter permits, to our professional advisers under a duty of confidence, or where the law requires. This obligation survives the end of an engagement. What we publish in the register comes from published documents, never from client material.
Acceptable use
You may not use the site to attack it, to attempt access to systems behind it, to scrape it at a rate that interferes with its operation, or to present register data as something it is not, including as a determination about a named project that the entry does not make. Attribution under CC BY 4.0 must not suggest Kyroq endorses your use.
Liability
The website and the register are provided as they are, free of charge, and we do not warrant that they are complete, error-free or uninterrupted. To the extent the law allows, we accept no liability for loss arising from reliance on the website or the register.
For work under an engagement, our liability is set out in the engagement letter and, unless it says otherwise, is limited to the fees paid for that engagement. We do not exclude or limit liability for death or personal injury resulting from negligence, for fraud, or for anything the law does not permit us to exclude. We are not liable for indirect or consequential loss, including loss of profit, business or opportunity.
Termination of an engagement
Either party may end an engagement on written notice as the engagement letter provides. Fees for work done to the date of termination remain payable. Confidentiality, intellectual property and liability terms survive termination.
Use of your name
We do not name clients, design partners or pilot participants without a signed agreement and their written permission. We may describe work in general terms that do not identify a client.
Governing law
These terms, and any engagement unless its letter says otherwise, are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction over disputes arising from them.
General
If any part of these terms is found unenforceable, the rest stands. A failure to enforce a term is not a waiver of it. You may not assign your rights under an engagement without our written consent. Neither party is liable for a failure that results from events outside its reasonable control. We change these terms when what we do changes; the date at the top is the date of the current version.
